Cottonwood Forest Rental Policy
 

Rental Policy:
We are an equal opportunity housing provider. We fully comply with federal fair housing laws. We do not discriminate against any person because of race, color, religion, sex, national origin, familial status, or handicap. We also comply with state and local fair housing laws. We will make reasonable modifications for handicapped individuals.

Apartment availability: 
Condominiums are available to lease when they become vacant. A condominium may also become available when an application is denied or when an applicant cancels his/her move-in. A condominium may be held until approval or for up to 3 days, upon receipt of application from each adult with paid application fee of $25.00.  A condominium may be held for a prospective resident for 30 days upon the completion and approval of a rental application, endorsement of a lease agreement and payment of a $350 non-refundable holding fee. Upon move-in, that $350 will be applied to required move-in costs. First Rent is due upon picking up the keys.  Applications should be submitted 30-60 days prior to desired move in date.   

Age:
Applicant must be of legal age, 18 years or older. All occupants 18 years or older must fill out an application.

Credit History: Applicants are required to have a good credit history. Credit history from the last 5 years will be considered. History of late payments and/or collection accounts, unpaid state or federal tax liens, foreclosure, vehicle repossession, utility or telephone collection, landlord/tenant civil judgment or eviction in the last 5 years will not qualify for lease of a rental home.

Residential History: Previous residency must be verifiable. A Verification form will be sent to current/former landlord for a record of payment history and information regarding any damages or incidents while applicant was living there.

Criminal History: Criminal background checks are automatically conducted as part of our credit history requests. An applicant will be denied if there is a history of serious criminal activity (convicted of a felony or high misdemeanor or is listed as a criminal sexual offender with offenses in the 1st and 2nd degrees or offenses involving children) – including any member of family or occupant included in lease.

Employment/Income: Employment history must be verifiable. A Verification form will be sent to current/former employer for a record of income paid to applicant. If no employment history exists, applicant must show means of financial support for a period of one year. If unable to contact present employer, current check stubs equaling one month of pay will be accepted as verification. If applicant is self-employed, tax records dated within one year will be reviewed. Other sources that will be considered as income may include, but are not limited to trust funds, social security or disability benefits, child support, and alimony.

Occupancy: For reasons of public health and building system capacity, the following occupancy guidelines have been established:  Maximum of 4 persons and 2 vehicles per condominium.

Other Rental Criteria: A prospective tenant may be denied if applicant…
- Cannot provide proper identification.
- Fails to complete and sign application or lease.
- Falsifies information on application or lease.
- Has a history of disturbing neighbors and/or property destruction.
- Plans to use the premises for other than living purposes.
- Writes check for application fee, holding deposit, security deposit,
   or first month’s rent that is not honored by the bank.
- Has unauthorized pets.

LEASE TERMS:  Cottonwood Forest offers 6month and 12 month lease options to new residents.  Six month lease terms are provided with a monthly fee of $50.00.  Current residents are offered more flexible renewal terms including month-to-month leases.

EARLY LEASE TERMINATION POLICY:  If you need to terminate your lease prior to your lease expiration we require that you provide us with a 30-day written notice of your intent to terminate your lease early.  Rent must be paid through the one month notice period.  In addition, your account will be assessed a penalty equal to two rental periods that is due in full by the stated vacancy date AND you forfeit all monies paid for security deposit.  This fee is considered a penalty for early termination and is at no time considered to cover damages or unpaid rent that may have occurred.

These occupancy standards are regulations set in place by Cottonwood Forest Condominium Association and Cottonwood Associates, LLC. These guidelines are used to ensure fair and equal service to prospective residents and our current residents. Cottonwood Associates and Cottonwood Forest Condominium Association is dedicated to providing a quality living environment and exceptional service. Association Bylaw Compliance:  All prospective residents and or residents may view a copy of the bylaws held at the association office upon request.  All residents must agree to comply with the Association Bylaws during their entire length of residency at Cottonwood Forest Condominiums.
